Pembeli Rokok Haram Berdepan Denda, Hukuman Penjara

PETALING JAYA: Anda boleh dikenakan denda, malah boleh dipenjara walau hanya membuat kesalahan membeli rokok haram, di bawah peraturan baru yang berkuatkuasa Rabu.

Pindaan kepada Peraturan-Peraturan Kawalan Hasil Tembakau 2004 di bawah Akta Makanan 1983 menetapkan bahawa bukan hanya menjual rokok dalam paket yang tidak mempunyai amaran kesihatan kerajaan dan gambar yang menyalahi undang-undang, tetapi membelinya juga menyalahi undang-undang.

Di bawah pindaan yang diwartakan pada Jun lepas, pembeli adalah sama seperti penjual yang mana mereka boleh dikenakan denda maksimum RM10,000, penjara sehingga dua tahun, atau kedua-duanya.

Difahamkan peruntukan baru ini bertujuan untuk membanteras kegiatan penyeludupan rokok haram ke negara ini.

Peraturan 15 (4A) Akta menetapkan: "Tiada seorang pun boleh menjual atau menawarkan jualan, membeli atau ada di dalam miliknya sebarang paket atau karton rokok yang tidak dicetak dengan teks-teks yang ditetapkan dan imej amaran kesihatan."

Paket rokok tanpa tanda amaran berkemungkinan besar diseludup masuk dalam negara kerana pengeluar-pengeluar di Malaysia telah mematuhi kehendak-kehendak percetakan yang ditetapkan beberapa tahun sebelum ini.

Ketua Pengarah Kastam Datuk Seri Khazali Ahmad berkata jabatan itu akan bekerjasama erat dengan Kementerian Kesihatan untuk menguatkuasakan peraturan baru ini.

Katanya hanya kementerian boleh bertindak terhadap pengguna rokok haram.

"Kita akan membantu kementerian itu dalam apa-apa cara yang boleh dan juga meningkatkan perisikan untuk mengenal pasti outlet-outlet (selain dari kedai-kedai) menjual rokok haram," katanya.

Beliau menambah bahawa jabatan itu akan meningkatkan operasi di pintu masuk utama di negara ini untuk mencegah penyeludupan.

Khazali berkata jabatan itu telah merampas lebih 1.6 bilion batang rokok bernilai lebih daripada RM134 juta sejak 2011.

"Sitaan bernilai RM811 juta duti tidak dibayar.

"Kita telah menunjukkan peningkatan dalam usaha membanteras penyeludupan rokok," katanya.

Pada tahun 2011, jabatan ini menyita rokok bernilai RM61.9 juta dan jumlah sitaan telah beransur-ansur berkurangan kepada RM42 juta pada 2012 dan RM31 juta tahun lepas.

"Kita perlukan kerjasama pengguna untuk mengurangkan permintaan bagi rokok ini," katanya.

Pada bulan September, British American Tobacco mendakwa Malaysia merupakan salah sebuah negara dengan tahap tertinggi penggunaan rokok haram di dunia, mengatakan bahawa penyeludup meraih kira-kira RM1 bilion setahun manakala Kerajaan mengalami kerugian sehingga RM2 bilion dalam duti eksais.

Timbalan Menteri Perusahaan Perladangan dan Komoditi, Datuk Noriah Kasnon dipetik sebagai berkata bahawa industri tembakau menyumbang RM3.52 bilion kepada cukai pendapatan di negara ini pada tahun 2012, berbanding dengan RM3.42 bilion pada tahun 2011.

Alonso finished a distant second in the drivers' championship and tensions between driver and team started to surface midway through the season. Both Alonso and Montezemolo have stressed that the ruction was blown out of proportion by the media, but Montezemolo admitted his driver was within his rights to be upset with Ferrari.

"He is the strongest of all and there are no problems with him," he said. "He was right to get mad, as we have to give him a competitive car, something we didn't do in the second half of the season."

He added: "It's obvious I'm not happy with the way things went. However, it's also true that we are the only team in the world for whom it's seen as a tragedy to come second, which seems something of an exaggeration to me. Clearly, we now need to win and we've had enough of finishing second."

Next year Ferrari will pair Alonso with Kimi Raikkonen in what is likely to be a fast but feisty partnership. Montezemolo believes only Mercedes' pairing of Lewis Hamilton and Nico Rosberg comes close.

"I am pleased I followed [team principal Stefano] Domenicali's recommendations regarding Kimi: when I met him, I saw he was on great form and extremely motivated and I was pleased to see how warmly he was received both inside and outside the team. I think the pairing we have, along with that at Mercedes, is the strongest in the 2014 championship."
